The Liberty Protection Safeguards were introduced by the Mental Capacity (Amendment) Act 2019 and will replace the Deprivation of Liberty Safeguards. The new scheme, when it comes into force, will enable local authorities and NHS bodies to authorise deprivation of liberty of individuals aged 16 and over who lack the relevant capacity, in any setting provided this is necessary and proportionate. The Liberty Protection Safeguards will introduce new statutory roles, including the approved mental capacity professional and the appropriate person.
